Contract Law

Drafting and review of contracts, formal notices, breach of contract and debt disputes.

Under Turkish Code of Obligations No. 6098, a contract is formed by mutual and corresponding declarations of intent (Art. 1). Many disputes can be prevented by drafting the contract clearly and fairly from the start.

Main topics

  • Drafting and review of lease, sale, service, work and agency contracts
  • Formal notices served through a notary
  • Disputes over breach, performance and default
  • Review of standard terms (Arts. 20–25)
  • Debt claims and preparation for enforcement

Limitation periods

Unless the law provides otherwise, claims are time-barred after ten years (Art. 146). Certain claims, such as rent, interest and claims under agency and work contracts, are time-barred after five years (Art. 147).

Before signing, always read the clauses on term, termination, penalties and jurisdiction.
