Foreigners who wish to stay in Türkiye longer than their visa or visa exemption allows must obtain a residence permit. Residence permits are governed by Law No. 6458 on Foreigners and International Protection (YUKK) and applications are handled by the Presidency of Migration Management.

Types of residence permit

Under Article 30 of the YUKK there are six types of residence permit:

  • Short-term residence permit (tourism, property ownership, scientific research, business connections and similar purposes)
  • Family residence permit (spouse and children of a Turkish citizen or of a foreigner holding a residence permit)
  • Student residence permit
  • Long-term residence permit (foreigners who have resided continuously for a long period)
  • Humanitarian residence permit
  • Residence permit for victims of human trafficking

The right permit depends on the purpose of your stay. Applying for the wrong type can lead to refusal.

Applications and time limits

First applications are, as a rule, made to the Turkish consulate in the country of which the foreigner is a citizen or lawfully resides; in the cases listed in YUKK Article 21, the application may be made in Türkiye to the provincial migration directorate. Renewal applications must be made before the current permit expires. Overstaying can lead to an administrative fine and, later, an entry ban (restriction code).

After a refusal or cancellation

The refusal, non-renewal or cancellation of a residence permit is an administrative act and is notified to the foreigner in writing. An annulment action can be filed against it before the administrative court. Under Article 7 of Administrative Procedure Law No. 2577, the general time limit is 60 days from notification.

Before filing a case, you may ask the authority that issued the decision, or its superior, to withdraw it within the same period; this application stops the time limit from running (İYUK Art. 11).

If implementing the decision would cause damage that is difficult to remedy and the decision is clearly unlawful, a stay of execution may be requested together with the case (İYUK Art. 27).

If a deportation order was issued together with the refusal, the time limit to challenge the deportation order is much shorter. Seek legal support on the day you receive the notification.

Practical tips

  • Note the date of notification; the time limit starts from that date.
  • Ask for a copy of your application file and the reasons for refusal.
  • If the refusal was due to missing documents, reapplying with the complete file may also be an option; which route is better depends on the case.
