When a deportation order may be issued against a foreigner and how to apply to the administrative court against it.

Author: Att. Ahmet Bertuğ Dönmez Date: 28 August 20261 min read

Deportation is an administrative decision to remove a foreigner from Türkiye and is governed by Articles 52 et seq. of Law No. 6458 on Foreigners and International Protection (YUKK). The decision is issued by the governorship.

When may it be issued?

The cases listed in YUKK Article 54 include staying without a valid residence permit, violating visa or residence periods, using false documents and posing a threat to public order or security.

Challenging the decision

The foreigner, their legal representative or lawyer may apply to the administrative court against the deportation order within seven days of notification (YUKK Art. 53/3). The time limit is very short; if missed, the decision becomes final.

If the court is applied to, the foreigner is not deported during the proceedings, subject to their consent and to certain cases listed in the law (e.g. decisions based on public security) (YUKK Arts. 53/3, 54).

Administrative detention

An administrative detention order may also be issued against a foreigner subject to deportation. It can be challenged before the criminal judgeship of peace (YUKK Art. 57).

When a deportation order is served, immediately keep the date of notification and a copy of the decision; the seven-day period runs from the day of notification.
