Inheritance Law
Disclaimer of inheritance, certificate of inheritance, division of the estate and partition.
Inheritance is governed by the inheritance provisions of Turkish Civil Code No. 4721. On the death of the deceased, the heirs acquire the estate as a whole; the debts pass to the heirs together with the assets (Art. 599).
Main topics
- Disclaimer of inheritance and its time limit (Arts. 605–619)
- Certificate of inheritance (Art. 598)
- Division of the estate and partition of jointly owned property (Art. 642)
- Disputes over wills and inheritance contracts
The time limit for disclaiming an inheritance is three months and, for statutory heirs, generally runs from the day they learn of the death (Art. 606).
If you suspect the deceased had debts, do not sell estate assets or withdraw money from their accounts before the time limit expires.
