Deportation and administrative detention

The seven-day time limit to challenge a deportation order and applying to the criminal judgeship of peace against administrative detention.

Deportation is an administrative decision to remove a foreigner from Türkiye, issued by the governorship (YUKK Art. 53). It may be issued in the cases listed in Article 54, such as staying without a valid residence permit, violating visa or residence periods, using false documents or posing a threat to public order or security.

Challenging a deportation order

The foreigner, their legal representative or lawyer may apply to the administrative court within seven days of notification (YUKK Art. 53/3). The period is very short; if missed, the decision becomes final.

Administrative detention

Where there is, for example, a risk of absconding, an administrative detention order may be issued and the foreigner held at a removal centre. Detention cannot exceed six months; in cases such as non-cooperation it may be extended by up to six more months (Art. 57).

An administrative detention order can be challenged before the criminal judgeship of peace; the application does not automatically suspend detention (Art. 57/6).

When a deportation order is served, keep a copy and the date of notification immediately; the seven-day period starts that day.
